1.About Odd Thunder
Odd Thunder is an independent creative project operated by a private individual. It is not a registered company or other legal entity. In these Terms, “Odd Thunder”, “we”, “us” and “our” mean the operator of the project, and “you” means anyone who uses the Services.
2.Accepting These Terms
By visiting the website, downloading anything from it or otherwise using the Services, you agree to be bound by these Terms. Some projects have their own terms or licenses, as described in “Our Brands and Additional Terms”. When you use one of those projects, you also agree to its own terms or license.
If you use the Services on behalf of someone else, for example as a parent allowing a child to play, you are responsible for making sure they follow these Terms.
3.What We Offer
The Services are a free showcase of games, software, tools, source code, artwork and news created by Odd Thunder. You do not need an account to use them, and nothing on the Services is sold.
If we ever offer paid products or user accounts, we will show you any additional terms that apply before you buy or sign up.
4.Who May Use the Services
Anyone may browse the Services. If you are under the age at which you can make a binding agreement where you live, you should use the Services only with the permission of a parent or guardian.
Some projects contain content intended only for adults. These projects ask you to confirm that you are 18 or older. Do not open them if you are under 18. Parents and guardians are responsible for supervising what their children access.
5.Following the Laws of Your Country
The Services can be used from anywhere in the world, and the laws and rules about games, software, downloads, age ratings and online content differ from country to country.
By using the Services, you agree to follow all laws, regulations and rules that apply to you in the country or region where you live or from which you access the Services. You are responsible for making sure that your use of the Services, including downloading, installing and using any project, is allowed where you are. If any part of the Services is not allowed where you are, do not use that part.
We do not promise that the Services or any project are suitable, legal or available in every country.
6.Our Content and Intellectual Property
The Services and everything on them, including games, software, code, artwork, music, text, logos and the names Odd Thunder and our brands, belong to Odd Thunder or to the people who license them to us, and are protected by copyright and other laws. These Terms do not transfer any ownership to you.
Subject to these Terms, you may view the Services and use downloaded projects for your own personal, non-commercial use, as allowed by each project's license.
You are welcome to share links, screenshots and gameplay videos of our projects, as long as you do not present them as official or as endorsed by us. You may not otherwise copy, republish, sell or redistribute our content, except as allowed by a project's license or by law.
7.Downloads and Software
Each downloadable project comes with the license shown on its page, such as Freeware or an open-source license. That license sets out what you may do with it. You install and run downloaded software at your own risk.
We take care to keep our files safe, and many downloads show a SHA-256 checksum so you can confirm the file has not been changed. Only download our projects from the Services or from links we provide.
Some tools, such as automation or modding tools, may not be allowed by the rules of other games, apps or services. You are responsible for following those rules. We are not responsible for any action another service takes against you or your account because of how you use our tools.
8.Open-Source Code
Source code that we publish as open source, whether on the Services or on a code-hosting platform, is governed by its open-source license. If these Terms conflict with an open-source license, the license prevails for that code. Nothing in these Terms limits the rights that license gives you.
9.Age Ratings and Content Warnings
“Odd rated” age ratings and content warnings are our own guidance, to help you decide what is right for you or your family.
Ratings from official rating boards are labelled NOT CERTIFIED when they are our own estimate and were not issued by that board. Only ratings labelled as certified were issued by the board shown.
Ratings are guidance only and may not reflect every rule in your country.
10.Acceptable Use
When using the Services, you agree not to:
- break the law or encourage others to do so;
- attempt to gain unauthorised access to the Services, their administration area, their providers or other users' devices;
- interfere with, overload or disrupt the Services, or test them for weaknesses without our permission;
- collect content automatically in a way that places an unreasonable load on the Services;
- upload or distribute malware, or modify our files and pass them off as ours;
- re-host or sell our downloads as your own, or link to our files in a way that misleads people about where they come from; or
- impersonate Odd Thunder, our brands or anyone else.
11.Ideas and Feedback
We love hearing from players and users. If you send us ideas, suggestions or feedback, you agree that we may use them to improve our projects without any obligation to you. We may already be working on similar ideas, and many ideas occur to more than one person.
Please do not send us anything you consider confidential. Sending us an idea does not transfer ownership of your own separate creative work to us.
12.Our Brands and Additional Terms
Odd Thunder publishes some projects under brands, studios or labels that are part of Odd Thunder. These Terms apply to all of them.
Some brands and projects have their own terms, end-user license agreements, licenses or privacy notices (“Additional Terms”). Where they exist, Additional Terms apply in addition to these Terms. If they conflict with these Terms, the Additional Terms prevail for that brand or project.
13.Other Platforms and Links
Some projects are available on, or link to, platforms run by others, such as game platforms, app stores, video platforms and code-hosting sites. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for their content, services or practices.
14.Changes to the Services
We work on the Services in our spare time and may change, pause or remove any part of them, including any project or download, at any time. We are not obliged to keep any project available, to release updates or to provide support, although we will try to help where we can.
15.Disclaimer
The Services and all projects are provided free of charge, “as is” and “as available”. To the fullest extent permitted by law, we make no promises or warranties of any kind, whether express or implied, including that the Services will be uninterrupted, error-free or free of harmful components, or that any project will meet your needs.
Nothing in these Terms affects any rights you have under the law that cannot be excluded or limited by agreement.
16.Limitation of Liability
To the fullest extent permitted by law, Odd Thunder will not be liable for any indirect or consequential loss, or for any loss of data, profits or opportunities, arising from your use of, or inability to use, the Services or any project. This includes loss caused by running downloaded software on your device. Because the Services are free, our total liability to you for any claim relating to them is limited to fifty euros (EUR 50).
What this does not limit. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, for harm caused intentionally or through gross negligence, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, you keep all the rights that the law of your country gives you and that cannot be waived by contract.
17.Ending Access
If you seriously or repeatedly break these Terms, or misuse the Services in a way that harms the Services or other people, we may block or limit your access to them.
18.Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page with a new “Last updated” date. If a change is significant, we will make it clearly visible on the Services. Updated Terms apply from the time they are posted and do not affect anything that happened before. If you continue to use the Services after an update, you accept the updated Terms. If you do not agree, please stop using the Services.
19.Governing Law and Disputes
These Terms are governed by the laws of the country in which Odd Thunder is run.
If you are a consumer, this choice of law does not take away the protection of mandatory rules in the law of the country where you live. You may bring a claim in the courts of the country where you live, where that law allows.
If you have a problem with the Services, please contact us first. We will try to resolve it quickly and fairly.
20.General
- Whole agreement. These Terms, our Privacy Policy and any Additional Terms are the whole agreement between you and Odd Thunder about the Services.
- Severability. If any part of these Terms is found invalid or unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a part of these Terms straight away, we can still enforce it later.
- Transfer. We may transfer Odd Thunder or these Terms to someone else, for example if a project is handed over. This will not reduce your rights.
- Language. These Terms are written in English. If we provide a translation, the English version prevails to the extent permitted by law.
21.Reporting a Problem or Copyright Concern
If you believe something on the Services infringes your copyright or other rights, or you want to report a security problem or harmful content, please contact us by email at support@oddthunder.com. Include enough detail for us to find and review it. We will look into every report and remove or fix content where appropriate.
22.Contact Us
If you have any questions about these Terms, please contact us by email at support@oddthunder.com.
